1. RULES

"Image(s)" shall mean animations, clipart, composites, digital footage, digital video, film footage, fonts, graphics, illustrations, images, motion sequences, photographs or any other visual representation regardless of whether the Image(s) are obtained via download from any TEKNOAKADEMI'S Web site, delivered via any storage media (CD, DVD, disk, etc.) that is now known or may become known in the future, or obtained from a TEKNOAKADEMI'S authorized distributor, together with all accompanying metadata and other material.

"You" shall mean a single: (i) individual, (ii) legal entity (corporation, partnership, LLC, sole proprietorship, etc.), or (iii) agent acting on behalf of a single individual or entity.

3.PRIVACY

Dental-animation cannot ensure or guarantee privacy for Dental-animation users. It is therefore recommended that this service not be used for the transmission of confidential information. Any such use shall be at the sole risk of the user, and Dental-animation and its affiliate and related companies shall be relieved of all liability in connection therewith.

4. BUYING OVER THE INTERNET

6.RECOURSE

If you are dissatisfied with the Dental-animation Site or with any terms, conditions, rules, policies, guidelines, or practices of Dental-animation in operating the Dental-animation Site, your sole and exclusive remedy is to discontinue using the Dental-animation Site.

You agree to defend, indemnify and hold Dental-animation and its affiliate and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any Violation of this Agreement by you or users of your account, or in connection with the use of the Dental-animation Site or the Internet or the placement or transmission of any message, information, image or other materials on the Dental-animation Site or on the Internet by you or users of your account.

9.TRADEMARKS

Dental-animation and other names, logos and icons identifying Dental-animation and Dental-animation's products and services referenced herein are trademarks or registered trademarks of Teknoakademi Information Technologies Center Co. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.

10. DISCLAIMER

THE IMAGE(S) CONTAINED IN THIS ARCHIVE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE ENTIRE RISK AS TO THE RESULTS AND THE PERFORMANCE OF THE IMAGE(S) IS ASSUMED BY THE USER, AND IN NO EVENT WILL DENTAL-ANIMATION BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL OR DIRECT DAMAGES SUFFERED IN THE COURSE OF USING THE IMAGES IN THIS ARCHIVE.

11.MISCELLANEOUS

This Agreement, including any and all documents referenced herein, constitute the entire agreement between Dental-animation and you pertaining to the subject matter hereof. Dental-animation's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any of the provisions contained in this Agreement be determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the laws of Republic of Turkey. Any claims shall be brought solely in the District Court of Istanbul and you expressly consent to the exclusive jurisdiction of the courts of Istanbul, Turkey.
